Terms of Service

These Terms of Service ("Terms") govern your access to and use of PromoTastic. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, do not use PromoTastic.

Use of the Platform

PromoTastic is a business management platform for the promotional products and decorated-apparel industry. You may use it only for lawful business purposes and in accordance with these Terms. You are responsible for all activity that occurs under your account.

Accounts and Access

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at hello@promotastic.ai if you suspect unauthorised access.

Subscriptions and Billing

PromoTastic is offered on a subscription basis. Fees are charged in advance for each billing period. All fees are non-refundable except as required by applicable law or as explicitly stated in a separate agreement. We reserve the right to change pricing with 30 days' notice.

Acceptable Use

You agree not to use PromoTastic to transmit unlawful, harmful, or fraudulent content; attempt to gain unauthorised access to our systems or other users' accounts; reverse-engineer, decompile, or reproduce any part of the platform; or resell or sublicense access without our written permission.

Your Data

You retain ownership of all data you upload to PromoTastic. You grant us a limited licence to store, process, and display that data solely to operate and improve the platform. We will not access your data except to provide the service or as required by law.

Intellectual Property

All software, design, trademarks, and content provided by PromoTastic remain our intellectual property or that of our licensors. Nothing in these Terms transfers any ownership of our IP to you.

Disclaimer of Warranties

PromoTastic is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability. We do not warrant that the platform will be error-free at all times.

Limitation of Liability

To the maximum extent permitted by law, PromoTastic's total liability for any claim arising from your use of the platform is limited to the fees you paid in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Termination

Either party may terminate this agreement at any time. Upon termination, your access to the platform will cease. We may retain anonymised aggregate data for analytics purposes. You may export your data during the 30-day period following termination.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect. Continued use of PromoTastic after that date constitutes acceptance of the revised Terms.
